Either you and the other party, or the Judge. You do have control over this process. I would encourage you to enter mediation with a strong mediator. Think about the way that you can divide up your assets that is mutually agreeable between the parties. It would necessarily be a compromise, but that is better than having a Judge decide your fate.
If you’re not able to agree regarding how assets are going to be divided in a divorce case, then you have to attend a permanent orders hearing and have the Judge decide. That’s like whirling the dice. You’re never really sure exactly how it’s going to play out. I would encourage you to get a good attorney, and I would be happy to help you in this regard.
